Cependant, il existe des r\u00e8gles strictes \u00e0 respecter pour garantir un \u00e9quilibre entre les besoins de l&#8217;entreprise et les droits des salari\u00e9s. Alors, dans quelles conditions un employeur peut-il <strong>imposer des cong\u00e9s pay\u00e9s<\/strong> \u00e0 ses salari\u00e9s&nbsp;?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le droit d\u2019imposer des cong\u00e9s pay\u00e9s<\/h2>\n\n\n\n<p>L\u2019employeur a le pouvoir de fixer les dates de prise des cong\u00e9s pay\u00e9s, mais ce droit s\u2019exerce dans un cadre r\u00e9glement\u00e9. <\/p>\n\n\n\n<p>Notez que la p\u00e9riode de r\u00e9f\u00e9rence pour la prise des cong\u00e9s pay\u00e9s est g\u00e9n\u00e9ralement d\u00e9finie par la loi ou par un accord collectif, et l\u2019employeur ne peut pas y d\u00e9roger \u00e0 sa convenance.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Si un salari\u00e9 n\u2019a pas accumul\u00e9 suffisamment de jours de cong\u00e9, ceux-ci peuvent \u00eatre pos\u00e9s <strong>en anticipation<\/strong> afin d\u2019\u00e9viter que le salari\u00e9 ne se retrouve \u00e0 prendre des cong\u00e9s sans solde.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Nombre de cong\u00e9s qu\u2019il est possible d\u2019imposer<\/h3>\n\n\n\n<p>Le Code du travail limite \u00e0 <strong>24 jours ouvrables<\/strong> (soit quatre semaines) la dur\u00e9e maximale d\u2019un cong\u00e9 pris en une seule fois. L\u2019employeur ne peut donc pas exiger que les cinq semaines de cong\u00e9s pay\u00e9s soient prises d\u2019un coup. <\/p>\n\n\n\n<p>La cinqui\u00e8me semaine doit \u00eatre prise \u00e0 un autre moment, que ce soit librement par le salari\u00e9 ou \u00e0 l\u2019initiative de l\u2019employeur, dans le respect des r\u00e8gles pr\u00e9vues.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">D\u00e9lai de pr\u00e9venance \u00e0 respecter<\/h3>\n\n\n\n<p>Pour imposer des cong\u00e9s, l\u2019employeur doit informer ses salari\u00e9s au moins un mois \u00e0 l\u2019avance. Ce <strong>d\u00e9lai de pr\u00e9venance<\/strong> est une obligation l\u00e9gale, sauf circonstances exceptionnelles o\u00f9 des ajustements peuvent \u00eatre envisag\u00e9s.<\/p>\n\n\n\n<p>Certaines conventions collectives ou accords d\u2019entreprise peuvent \u00e9galement pr\u00e9voir des d\u00e9lais plus courts.<\/p>\n\n\n\n<p>En p\u00e9riode de crise, comme lors du Covid ou s&#8217;il y a une baisse d\u2019activit\u00e9 importante par exemple, des exceptions peuvent s\u2019appliquer, mais elles doivent toujours se conformer aux dispositions l\u00e9gales en vigueur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le droit de d\u00e9cider d&#8217;une fermeture annuelle<\/h2>\n\n\n\n<p>Dans certains cas, l\u2019employeur peut imposer des cong\u00e9s pay\u00e9s en raison d\u2019une fermeture annuelle de l\u2019entreprise. Cette fermeture impose \u00e0 <strong>l\u2019ensemble des salari\u00e9s<\/strong> de prendre leurs cong\u00e9s au m\u00eame moment. <\/p>\n\n\n\n<p>L&#8217;employeur doit toutefois respecter le d\u00e9lai de pr\u00e9venance d\u2019un mois pour informer les salari\u00e9s de cette fermeture. De plus, il est n\u00e9cessaire de <strong>consulter le comit\u00e9 d\u2019entreprise<\/strong> ou, \u00e0 d\u00e9faut, les d\u00e9l\u00e9gu\u00e9s du personnel pour valider cette d\u00e9cision.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Le droit de fixer l\u2019ordre de d\u00e9part des cong\u00e9s<\/h2>\n\n\n\n<p>L\u2019employeur a \u00e9galement le droit de <strong>fixer l\u2019ordre des d\u00e9parts<\/strong> en cong\u00e9 en tenant compte des contraintes de l\u2019entreprise. Il y a des p\u00e9riodes qui sont davantage sollicit\u00e9es par les salari\u00e9s pour poser leurs cong\u00e9s&nbsp;: cong\u00e9s d\u2019\u00e9t\u00e9, f\u00eates de fin d\u2019ann\u00e9e, vacances scolaires\u2026 Dans ce cas l\u00e0, il peut devenir compliqu\u00e9 de satisfaire tout le monde sans impacter le fonctionnement de l\u2019entreprise.<\/p>\n\n\n\n<p>Ces d\u00e9cisions doivent prendre en compte certains crit\u00e8res tels que <strong>l\u2019anciennet\u00e9 des salari\u00e9s ou leur situation familiale<\/strong>, dans le respect des conventions collectives en vigueur, et il faut \u00e0 nouveau respecter le d\u00e9lai de pr\u00e9venance d\u2019un mois.<\/p>\n\n\n\n<p>Cette organisation doit viser \u00e0 maintenir un \u00e9quilibre entre les besoins de l\u2019entreprise et ceux des employ\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les cas particuliers pour les cong\u00e9s impos\u00e9s<\/h2>\n\n\n\n<p>Bien que l\u2019employeur dispose d\u2019un pouvoir de direction en mati\u00e8re de gestion des cong\u00e9s, certaines situations particuli\u00e8res limitent sa capacit\u00e9 \u00e0 imposer des cong\u00e9s.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Cong\u00e9s impos\u00e9s et licenciement, d\u00e9mission, rupture conventionnelle<\/h4>\n\n\n\n<p>Dans le cas d\u2019un licenciement ou d\u2019une <a href=\"https:\/\/www.facture.net\/blog\/demissionner-creer-entreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">d\u00e9mission<\/a>, <strong>une fois la lettre de rupture re\u00e7ue<\/strong>, l\u2019employeur ne peut plus annuler des cong\u00e9s d\u00e9j\u00e0 planifi\u00e9s sans l\u2019accord du salari\u00e9. Les cong\u00e9s pris pendant la p\u00e9riode de pr\u00e9avis suspendent celui-ci, prolongeant d\u2019autant la dur\u00e9e du pr\u00e9avis. <\/p>\n\n\n\n<p>Si aucune p\u00e9riode de cong\u00e9s n\u2019a \u00e9t\u00e9 fix\u00e9e au moment de la <strong>notification de rupture<\/strong>, ni l\u2019employeur ni le salari\u00e9 ne peuvent imposer la prise de cong\u00e9s. La prise de cong\u00e9s doit alors \u00eatre d\u00e9cid\u00e9e d\u2019un commun accord entre les parties et le pr\u00e9avis ne sera suspendu que si les deux parties s&#8217;accordent par \u00e9crit.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Cong\u00e9s impos\u00e9s et ch\u00f4mage partiel<\/h4>\n\n\n\n<p>En p\u00e9riode de <a href=\"https:\/\/www.facture.net\/blog\/chomage-partiel-comment-ca-marche\/\" target=\"_blank\" rel=\"noreferrer noopener\">ch\u00f4mage partiel<\/a>, l\u2019employeur <strong>ne peut pas imposer<\/strong> \u00e0 ses salari\u00e9s de prendre leurs cong\u00e9s pay\u00e9s pour \u00e9viter une mise en activit\u00e9 partielle. L\u2019employeur peut toutefois encourager les salari\u00e9s \u00e0 le faire, mais il est interdit de les contraindre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Imposer les cong\u00e9s, un \u00e9quilibre entre droits et responsabilit\u00e9s<\/h2>\n\n\n\n<p>L\u2019employeur dispose de <strong>certains droits<\/strong> pour organiser la prise des cong\u00e9s pay\u00e9s, mais ceux-ci sont strictement encadr\u00e9s par la loi et les conventions collectives.
